Since early 2023, Artificial Intelligence has started to disrupt numerous industries. Reactions have ranged from apocalyptic alarmism to excited futurism. AI has also stormed into the real estate industry. For clients, there are hopes of faster deals, more transparent valuations, and endless data-driven insights. For agents, there is smart document management, scaleable interaction with consumers, countless marketing shortcuts, and much more. Yet, beneath the surface of this digital revolution lie urgent questions that many in the industry have yet to confront.
I’ve admitted that one of the reasons I joined REAL was due to their advances in technology, including their implementation of AI in our backend document management and the forthcoming “Leo for Clients” that put this company lightyears ahead of the competition (at least from what I’ve seen). I haven’t been shy with promoting these advancements and I wasn’t surprised when the company was recently named to have the “Best AI-Based Real Estate Solution of the Year” at the 2025 AI Breakthrough Awards. Additionally, as I was in the process of writing this article, Real also bought FlyHomes.com’s home search AI technology. The point is that the company I chose to join is on the cutting edge of implementing AI within the real estate sector, which is something I’m proud of. However, we also need to have a hard look at the ramifications of this execution – obviously not just us, but the entire industry needs to grapple with the intellectual, ethical, moral, and potentially legal consequences of AI.
Evolving Landscape
When I got my real estate license in 2010, the use of social media was pretty commonplace for the general public, yet I was surprised how many agents in my office didn’t even have a Facebook profile or business page set up yet. I had been using Facebook since late 2004 when it was opened up to college students in Canada (you needed a dedicated college email address to have an account). I started my business page in 2010 immediately upon getting licensed (my personal profile was hacked in 2023 and I lost all administrative access to my business page – I’ve barely used Facebook for business purposes since). Facebook brand pages had been around since late 2007 and while many agents had business pages, it still wasn’t universal by 2010. However, within just a couple years, it was rare to find a producing agent without a Facebook page.
Since then, agents have utilized Instagram, Youtube, TikTok, LinkedIn, Reddit, and probably every social media platform out there for marketing purposes. However, AI is not social media. It isn’t just another platform. It isn’t a “Social Media 1.0 to 2.0” evolution. It represents a fundamental shift in technology that may be more disruptive to human society than the industrial revolution or the internet itself. While some social media gurus will focus on how to use AI to boost website SEO, provide quick, scalable communication with clients, and generate “art”, there are serious questions regarding the diminishing professionalism and competency, systemic prejudice in algorithms, and lack of transparency in data collection. We need to face these challenges now, before they overwhelm us.
Erosion of Expertise
This is something that we are witnessing across many industries. Unfortunately, many professionals are undoing much of their own value and service to the public in the name of efficiency and, well, being the cool AI kid on the block. Don’t get me wrong, if AI could effectively replace expertise of learned professionals, then it may have a place – if not morally, at least logistically per the mechanisms of capitalism. However, that’s not what we are seeing – yet. Instead, human-based expertise is too often falling by the wayside of flawed algorithms.
The danger isn’t just that AI might one day replace expertise: it’s that it can erode it long before that day ever comes. In real estate, where local knowledge, negotiation skill, and the ability to read subtle human cues are the difference between a good deal and a disastrous one, expertise is built through experience, mistakes, and the gradual accumulation of context.
When we hand over key parts of our role to AI – whether it’s pricing recommendations, marketing content, or even basic client communication – we risk letting those muscles of expertise atrophy. A new agent who relies on AI to write every listing description may never learn how to identify the property features that truly matter to buyers in their market. An experienced agent who uses AI to handle negotiations may gradually lose the instinct to catch red flags in an offer. A customer who engages with a AI-enabled chatbot on a real estate website may receive highly inaccurate information.
And the trouble is, AI doesn’t have skin in the game. It can’t be held accountable in court, it doesn’t have to repair its reputation after a bad deal, and it won’t have to explain to a client why they sold for less than they should have. That responsibility, and the judgment that comes with it, remains squarely on us.
The result is a slow but real shift: the more we let AI “think” for us, the less we are actually thinking. The less we are thinking, the less valuable we become. What happens when the public perceives, rightly or wrongly, that we’re simply middlemen for an algorithm?
Legal Ambiguities
Real estate is already a minefield of regulation, licensing requirements, fiduciary duties, and disclosure obligations—and now we’re layering AI over top of it. The law has barely begun to catch up.
Who’s responsible if an AI-generated “agent” misguides a seller on what is required to disclose? What happens if a chatbot gives a prospective buyer inaccurate information about zoning, leading them into a costly mistake? Is the liability on the agent who used the tool, the brokerage that provided it, or the company that built the AI?
Even more complicated is the question of agency. If an AI assistant directly interacts with a consumer, is it considered to be acting as the agent’s representative? If so, does every statement it makes—accurate or not—carry the weight of licensed advice under real estate law? We may soon find ourselves in a situation where an algorithm can trigger legal obligations or violations without the agent even realizing it.
There’s also the cross-jurisdictional mess. AI tools don’t respect provincial or state borders—they deliver answers from aggregated data sets that may not comply with local disclosure laws, MLS rules, or advertising restrictions. That might mean agents are inadvertently breaking laws they never knew applied.
Until regulators address these gaps—and they will, eventually—it falls on us as professionals to set our own guardrails. We need to be hyper-aware that using AI doesn’t remove our liability. If anything, it may increase it, because the courts won’t care how we got the information—only whether we were right to rely on it.
Displacement of Human Professionals
The question of whether AI will replace real estate agents isn’t theoretical—it’s already happening in adjacent industries. Travel agents, once essential to booking flights and vacations, saw their roles gutted by online platforms. Mortgage brokers are increasingly competing with automated lending portals. Even lawyers and accountants are feeling pressure from AI tools that can draft contracts, process filings, and run complex analyses in seconds.
Real estate has long been protected by the idea that our work is too nuanced, too human, to be automated. But as AI gets better at analyzing markets, drafting listings, answering questions, and even simulating conversation with empathy, the line between “agent” and “algorithm” begins to blur. If consumers believe they can get the same results—or close enough—without paying commission, many will at least try.
The more the industry markets AI as a complete solution, the more we train the public to think people are optional. The danger isn’t just that a few agents will lose business to a flashy new app—it’s that we may be accelerating a shift where the perceived value of a human advisor becomes a luxury, not a necessity.
That displacement won’t happen all at once. It will start in the segments where consumers feel the least risk—entry-level homes, low-complexity transactions, investor bulk purchases—and gradually creep upward. And if history is any guide, the people most affected will be newer agents, smaller brokerages, and professionals in already-competitive markets.
The irony is that AI may not even perform as well as a skilled human in many of these cases. But perception often drives reality, and once the market decides that “close enough” is good enough, there’s little turning back.
Bias in Algorithms
One of the most dangerous myths about AI is that it’s somehow objective—that because it’s “just math,” it must be neutral. In reality, algorithms inherit the biases of the data they’re trained on and the people who build them. If the training data reflects historic inequities in lending, neighborhood development, or appraisal values, the AI will quietly perpetuate those same patterns—just with the credibility of a “machine” behind it.
The problem is compounded by opacity. These systems rarely tell you why they arrived at a certain conclusion—they just present the result with an air of authority. That makes it difficult for agents, clients, or regulators to detect when bias is creeping in. By the time someone notices, the damage—missed opportunities, lower valuations, or skewed market exposure—may already be done.
And because AI operates at scale, bias doesn’t just happen one transaction at a time. It can happen to thousands of people in a matter of seconds. That’s not a glitch—it’s a systemic risk.
For an industry that already struggles with public trust, allowing prejudice to be baked into our digital tools isn’t just an ethical failure—it’s a reputational one. If we don’t demand transparency, oversight, and rigorous testing now, we risk building a future where discrimination isn’t just present—it’s automated.
Data Collection
In real estate, data has always been currency: MLS records, sales histories, zoning maps, buyer demographics. AI doesn’t just use this data; it devours it. The more information we feed it, the more accurate and capable it becomes, or so the promise goes. But that hunger raises urgent questions about what data is being collected, how it’s being collected, and who it ultimately serves.
When an AI tool is plugged into every stage of a transaction — from the first online search to the final signed contract — it’s not just storing facts about square footage and sale prices. It can track client behaviours, communication patterns, financial details, even the timing and tone of responses. This creates an incredibly detailed, incredibly valuable profile of individuals. This data could, in the wrong hands, be exploited for purposes far beyond buying or selling a home.
The truth is, most consumers have no idea how much personal information they’re handing over when they interact with AI-driven real estate platforms. And many agents don’t, either. Privacy policies are often written to be legally airtight but practically unreadable, and “consent” is reduced to a pre-checked box buried at the bottom of a signup page.
The stakes aren’t hypothetical. Data breaches happen. Companies get sold. Platforms pivot their business models. A buyer’s search history that’s harmless today could be used tomorrow to target them with predatory offers—or to deny them opportunities altogether.
If the industry doesn’t get ahead of these concerns with clear, transparent, and client-first data practices, we risk creating a future where buying a home means surrendering far more than money. In the rush to modernize, we cannot forget that the most valuable asset in a real estate transaction might not be the property—it might be the data about the people involved.
Blind Faith in the Machine
AI’s power in real estate isn’t just in the insights it delivers, it’s in how quickly and confidently it delivers them. The problem is, confidence is not the same as truth. Many of these systems operate as “black boxes”: they give an answer, but not the reasoning behind it. Agents and clients alike are left to trust that the machine knows best, even when the logic is invisible.
That lack of transparency is dangerous in a profession built on fiduciary duty. If an AI pricing tool suggests listing a property at $1.2 million, how do we know which comparables it used, what weight it gave to each, or whether it excluded certain neighbourhoods entirely? If an AI assistant recommends a mortgage product, was that based on the client’s best interest, or on a commercial partnership the platform has with a lender? Without visibility into the decision-making process, it’s impossible to separate unbiased analysis from hidden influence.
Accountability is just as murky. If an AI-generated marketing campaign uses copyrighted images without permission, who’s on the hook—the agent who clicked “generate,” the brokerage that provided the tool, or the tech company that built it? When a chatbot gives incorrect legal advice to a client, can the liability stop at “the AI made a mistake,” or does the responsibility ultimately fall on the human who deployed it?
The public already struggles to trust the real estate industry. If we embrace tools that can’t explain themselves and can’t be held to account, we’re asking consumers to place blind faith in systems they neither understand nor control. That’s not innovation, it’s abdication.
If AI is going to be a legitimate partner in this industry, it must be explainable, auditable, and subject to the same ethical and legal standards as the professionals who use it. Otherwise, we risk building a future where the buck stops… nowhere.
Manipulation and Misinformation
Every technological leap creates new opportunities – not just for progress, but for exploitation. In real estate, AI has the power to inform buyers, sellers, and investors with unprecedented precision. It also has the power to subtly manipulate them.
An AI that controls what listings appear first, what price trends get emphasized, or which “similar homes” are recommended can shape buyer behavior without the user ever realizing it. If that AI is influenced by hidden partnerships, paid placements, or biased training data, consumers may be making life-altering decisions based on skewed or incomplete information.
The problem isn’t just intentional manipulation, it’s also unintentional misinformation. AI tools can generate property descriptions, market reports, or even “expert” analysis that sounds authoritative but contains factual errors. And unlike a human agent, who can be questioned directly and held accountable, an AI will confidently present falsehoods without hesitation or warning.
A buyer who believes an AI’s overly optimistic market projection might overpay. A seller who trusts an inflated valuation might turn down fair offers. Even more troubling, misinformation can spread at machine speed—thousands of clients receiving the same flawed advice in seconds.
We cannot afford to outsource our integrity to systems that can be gamed, corrupted, or simply wrong. If AI is going to play a role in shaping consumer perceptions, the burden is on us to ensure those perceptions are rooted in truth, not in algorithmic convenience or corporate influence.
Potential Solutions
We’re not going to stop AI. The genie isn’t just out of the bottle, it’s building a faster, smarter bottle factory. The real question isn’t whether AI will reshape real estate, but whether we’ll shape it intentionally or let it happen to us.
That means getting ahead of the technology before it outruns our ethics, our laws, and our professional standards. We can’t afford to wait for a catastrophic misuse or public backlash to spur action. The groundwork for responsible AI needs to be laid now: by regulators, by brokerages, by tech developers, and by agents themselves.
The following four areas offer a framework for moving forward: from formal regulation to professional practice, from independent oversight to data ethics. None of these are optional if we want to harness AI’s potential without sacrificing trust, transparency, or the value of human expertise.
1. Government and Industry Regulation
In real estate, we already operate within a dense web of licensing laws, agency rules, and disclosure requirements — and AI needs to be woven into that framework before its risks outpace its benefits.
Governments and real estate boards must work together to define clear standards for AI in areas like advertising compliance, fair housing, consumer data protection, and the scope of permissible advice. That might mean requiring AI tools to pass accuracy and bias audits before they can be deployed, or mandating that all AI-generated client interactions are logged and reviewable.
Just as MLS rules set a baseline for how listings are presented, industry-wide AI regulations can ensure these tools serve the public interest, not just corporate efficiency. Without that guardrail, we risk letting competitive pressure push brokerages and tech providers into an arms race of capability over caution — a race that history shows never ends well.
Ultimately, regulation isn’t about slowing down innovation. It’s about making sure that when AI is moving at full speed, it’s pointed in the right direction.
2. Brokerage & Industry Standards
While government regulation sets the outer boundaries, brokerages and individual professionals control the day-to-day reality of how AI gets used in real estate. We don’t need to wait for new laws to act responsibly — we can set higher standards now.
That starts with clear brokerage-level policies: requiring human review of AI-generated valuations, property descriptions, and client communications before they go out the door; setting guidelines on when and how AI can be used; and ensuring agents disclose to clients when significant parts of the service are AI-assisted.
Equally important is education. AI literacy should be as essential to our training as understanding contracts or agency law. Agents need to know not just how to use these tools, but how to question them, verify their outputs, and spot when something doesn’t pass the smell test. That’s not a one-time webinar — it’s ongoing professional development, just like continuing education requirements for legal updates or ethics.
If we, as an industry, set these standards and live by them, we send a powerful message: AI is here to enhance our service, not replace our judgment. Without that commitment, we risk handing over too much of our professional role to tools that can’t be held to the same standards we are.
3. Oversight & Transparency
One of the biggest risks with AI in real estate is that much of it operates behind a curtain. We get the output — a valuation, a recommendation, a market trend — but we don’t see the reasoning, the data sources, or the potential conflicts of interest behind it. That’s a problem not just for accuracy, but for trust.
Independent oversight can help pull back that curtain. Third-party audits of AI tools — similar to financial audits — could verify that they meet standards for accuracy, fairness, and compliance before they’re put in the hands of agents or clients. These audits should be ongoing, not one-and-done, because algorithms evolve over time and so do the biases hidden in their training data.
Transparency is the other half of the equation. Clients shouldn’t have to guess whether a recommendation came from their agent’s expertise or from a machine. Plain-language disclosures — a “nutritional label” for AI insights — can explain what data was used, what assumptions were made, and what limitations exist.
This isn’t about burdening the process with red tape. It’s about making sure that when AI influences a buying or selling decision, everyone involved knows where that influence came from and can evaluate it with eyes wide open. If we want clients to trust the tools we use, we have to let a little daylight in.
4. Data Privacy
AI thrives on data — the more, the better. But in real estate, that data isn’t abstract; it’s deeply personal. Financial records, search histories, family details, even patterns in how and when clients communicate — all of it can end up feeding the machine. That reality forces us to ask: just because we can collect and store it, should we?
A responsible approach starts with data minimization — gathering only what’s necessary to serve the client’s needs, not everything the system could possibly scoop up. From there, strict retention and deletion policies ensure that sensitive information doesn’t live forever in some forgotten database, waiting for a breach or a sale of the platform to change its fate.
Ethics also means clarity. Clients should know exactly what’s being collected, why, and who it’s shared with. Not in a 37-page legal document, but in plain, direct language they can actually understand. And when clients want their data removed, there should be a process to make that happen quickly and completely.
AI has the potential to make our services faster, smarter, and more personalized — but without strong privacy safeguards, it also has the potential to erode trust at the core of every transaction. If we want clients to believe that we’re acting in their best interest, we have to prove that their personal information is treated with the same care as the homes we help them buy and sell.
Conclusion
AI in real estate isn’t a passing trend: it’s a permanent shift. The question is no longer whether it will transform our industry, but whether it will do so in a way that strengthens or erodes the values we claim to uphold. Efficiency without ethics is just speed toward the wrong destination.
The tools themselves are neither moral nor immoral, they are amplifiers. They will magnify our best practices or our worst habits, depending on the guardrails we set, the transparency we demand, and the accountability we enforce. If we treat AI as a shortcut to avoid the hard work of expertise, diligence, and human connection, we’ll get exactly the industry we deserve.
Unchecked intelligence comes at a cost. The choice we face now is whether to pay that cost in foresight and responsible design, or in the trust and livelihoods we may lose if we wait too long to act. AI will not slow down for us — so it’s on us to keep pace, not just with innovation, but with integrity.
